False Allegation is a feminist tool used in their campaign. It is a frequently used accessory within divorce petition based on allegations of the husband's Unreasonable Behaviour. Reasons or Particulars have to be provided to support the alleged irretrievable breakdown of the marriage. The legal observance of weak behaviour petitions illustrated example of particulars which were frequently false. False Allegation could also be included to weaken or try and defeat any interest the father would have in matters to do with his children. An inference made that there had been alleged abuse would place the father in a weak position and as stated these would frequently be used in the petition particulars as well.

False rape allegation is a further example employed by the feminist movement. Many notable cases have come to light in recent years. Without exception all the notable cases brought by the Crown Prosecution Service (CPS) have failed. The  CPS are a political body who replaced the police and were created to secure conviction rather than bring forward cases for trial irrespective of pre judged value of evidence. Apart from the failed notable alleged rape cases the CPS have a dismal record in other areas of prosecution.

The false rape allegation matter has spread throughout the western world so much that most countries have movements challenging the situation. In this country courageous individuals have challenged their cases by vigorous defence and have succeeded. Most noteworthy were the Hamiltons who were bagged by allegations brought by one Ms Milroy-Sloan. This lady found herself at the Old Bailey in April 2003 answering charges of attempting to pervert the course of justice, was convicted and sent down for 3 years. She should have received the same sentence that would have been handed down to a convicted rapist which would have been somewhat longer than the time she received.

Such a sentence as Ms Milroy-Sloan received sends a strong signal to women who play the false rape allegation card that there will be a price to pay and hopefully will deter other women from trying this detestable practice.

Unfortunately for women who have been raped they can thank their sisters for introducing possible doubt when they report their experience.

Legislation in progress in mid 2004 in connection with The Sexual Offences Act 2003 is intent on increasing the conviction rate for the alleged crime of rape. The normal assumption of innocent until proved guilty will be overturned in the quest for political correctness and appeasement of the feminist movement and of course the female vote. 

On the day Solicitor General Harriet Harman launched a new Crown Prosecution Service policy for dealing with rape cases the extraordinary statistic was revealed based on random interviews with 7,000 women on behalf of The British Crime Survey  that 1 in 20 women had been raped at least once since they turned 16. Even more amazing is the revelation that 1 in 10 said they had been subject to  a form of 'sexual victimisation' which is believed to refer to minor assaults or harassment. 

The 1 in 20 figure referred to equates to 754,000 women nationally. This must be measured against the 11,544 rapes actually reported to police officers which one can perhaps assume means the police . The 1 in 20 figure is 65 times greater than the reported figure. Observers of these statistics are suggesting that this massive figure is extraordinarily high and completely out of line with published (reported) figures.

The 'new' system will require those accused to prove they had a 'reasonable belief'' that consent had been granted and perhaps more importantly the steps they took to establish this.

The objective of trying to increase the conviction rate for the alleged crime of rape has been a cornerstone of this administration's policy. However to hell with jurisprudence and the best practice of being assumed innocent until proved guilty this is now to be the baby going out of the window with the bath water.

How does the accused show the reasonable steps they took?. Most difficult it must be surmised when what was consensual sex taking place in the heat of the moment becomes a false allegation the next day.

Therefore to take a step in the direction of both ensuring the accused is protected from false allegation and that a woman is prevented from turning her part in a consensual act into a false allegation and perhaps more importantly that women who have actually been raped can obtain justice UK MENS AID have produced a pro forma that should be completed by both persons engaged in consensual sexual activity. This document can be produced as evidence by an accused person  they had a 'reasonable belief'' that consent had been granted and perhaps more importantly the steps they took to establish this.
